time of connection or within five (5) days of demand <br />by the City; and <br />(c) A quarterly water usage charge shall be payable by the <br />Owner within fifteen (15) days after mailing of the <br />City's billing. The parties hereto understand that <br />the usage charge may be increased or decreased by <br />amendment of the applicable City Ordinances and <br />Resolutions. <br />2. If the Owner fails to pay the amounts as provided <br />herein, the City will notify the City of Maplewood of the amount <br />of unpaid charges for certification of the same for collection <br />with the real estate taxes, pursuant to the Joint Powers <br />Agreement between the City and the City of Maplewood, which is <br />attached hereto as Exhibit "B ". <br />3. In addition to the amounts described above, the Owner <br />shall pay each quarter a "lost water" charge to the City based <br />on 20,000 gallons of water at the going rate, in lieu of <br />constructing a metering pit. Said charge does not entitle the <br />Owner to have access to nonmetered water service without prior <br />approval of the City. Owner also agrees to pay a charge for the <br />use of water during any fire which may occur on the Owner's <br />premises or adjacent properties, which require the connection to <br />the hydrants on the Owner's premises. Said charge is to be <br />based on the estimate of use, as determined by the City, <br />relating to the varying levels and daily pumping capacities. <br />-3- <br />Page 38 <br />
