FEB -25 -1991 16:03 FROM SIJEENEY & BORER <br />TO LITTLE-CANADA F.21/25 <br />intoxicating liquor in any theater, recreation hall, center, <br />dance hall, ball park, or other place of public gathering used <br />for the purpose of entertainment, amusement or playing of games, <br />unless the owner or lessee of the property or sponsor of the <br />event has obtained a license. <br />703.170. SUSPENSION AND REVOCATION. The Council shall <br />either suspend for up to 60 days or revoke any intoxicating <br />liquor license, or impose a civil fine not to exceed $2,000.00, <br />for each violation upon a finding that the licensee has failed <br />to comply with any applicable statute, regulation, or ordinance <br />relating to alcoholic beverages. Except in cases of failure of <br />financial responsibility, no suspension or revocation shall take <br />effect until the licensee has been afforded an opportunity for a <br />hearing. The lapse of required dram shop insurance or bond, or <br />withdrawal of a required deposit of cash or security, shall <br />effect an immediate suspension of any license issued pursuant to <br />this ordinance without further action of the City Council. <br />Notice of cancellation, lapse of a current liquor liability <br />policy or bond, or withdrawal of deposited cash or securities <br />shall constitute notice to a licensee of the impending <br />suspension of the license. Any suspension under this chapter <br />shall continue until the City Council determines that the <br />financial responsibility requirements of this chapter have met. <br />703.180. SPECIAL SUNDAY SALE. The holder of an "On -Sale" <br />liquor license under the Code, may apply to the council for a <br />special license to sell intoxicating liquor in a restaurant on <br />Sunday, provided that the liquor may be served only with meals <br />and only to people seated at tables. The application for such <br />license may be made at the same time and upon the same license <br />as the "On- Sale" licensee uses to apply for his regular <br />"On- Sale" license. The fee for a special Sunday liquor license <br />shall be Two Hundred Dollars ($200.00) per year. No such <br />license shall be issued to any "On- Sale" licensee unless said <br />licensee is operating a bonafide restaurant serving meals <br />regularly to the public and having facilities for serving at <br />least 30 people at one time. No intoxicating liquor shall be <br />served before 10:00 o'clock a.m. or after 1:00 o'clock a.m. on <br />Sunday. <br />Section 4. <br />Chapter 704 of the Municipal Code of the City of Little <br />Canada is hereby amended to read as follows: <br />704. SPECIAL ON -SALE WINE LICENSES <br />704.010. WINE LICENSES. No person, except a wholesaler or <br />manufacturer to the extent authorized under the State License <br />-17- <br />Page 20 <br />
