These <br />Ordinances were discussed by the City Council at its meeting of <br />December 26, 1990. <br />Pursuant to the Council's direction, Section 903.130 of the <br />proposed Ordinance has been revised to provide for a minimum <br />distance of 500 feet between principal adult uses and between <br />principal adult uses and other land uses as set forth in Section <br />903.130(B)(1)(a -e). We have also made various revisions as to <br />form in order that the Ordinance meets statutory requirements <br />and be in conformity with the present format of the Zoning <br />Ordinance and Municipal Code. Please note that I have deleted <br />the penalty provision found in page 7 of the Licensing <br />Ordinance. Section 101.090 of the Municipal Code already <br />provides for a penalty of a fine not to exceed $500.00 or <br />imprisonment for a term not to exceed 90 days for any violation <br />of the Code. <br />Separate Ordinances have been prepared for the licensing <br />and zoning provisions since the Zoning Ordinance must be <br />considered by the Planning Commission prior to enactment by the <br />City Council. I am, however, forwarding both of these <br />Ordinances to you at this time because I would anticipate that <br />they would be considered simultaneously. It is my understanding <br />that the Zoning Ordinance is on the agenda for the Planning <br />Commission meeting now scheduled for Thursday, January 10, <br />1991. Although the Planning Commission's recommendations will <br />relate to the Zoning Ordinance, the members will want to refer <br />to the Licensing Ordinance in their discussions. <br />Page 20 <br />
