WAIVER OF RIGHT TO APPEAL FROM SPECIAL ASSESSMENT <br />OF LITTLE CANADA IMPROVEMENT PROJECT 90 -21 <br />The undersigned, Rose Costa, single, and Peter Costa, Jr., and <br />Ilene Costa, husband and wife, are the owners of the <br />following- described property located in the City of Little Canada, <br />County of Ramsey, State of Minnesota, which is legally described as <br />follows: <br />Lots 4 through 11 and 21 through 31, Block 3, Gervais Heights, <br />Ramsey County, Minnesota. <br />The undersigned, their successors, representatives and assigns <br />understand and agree that the sum of $182,215.33 of the cost of <br />Little Canada Improvement Project 90 -21, relating to the construction <br />of streets and utilities to service the Costa Estates Plat, is to be <br />assessed against the above - described property. The undersigned <br />further understand and agree that the assessment shall be made <br />pursuant to Minnesota Statutes Chapter 429, and shall be certified <br />for payment to the Department of Taxation for Ramsey County. <br />The undersigned further state and agree that they have been <br />represented by counsel and that their attorney, Thomas Hartigan, has <br />fully advised them as to their rights and responsibilities under the <br />Development Contract and as to the assessment to be levied against <br />their property. The undersigned further acknowledge that the <br />Development Contract and the assessment of their property were the <br />subject of negotiations with the City of Little Canada. <br />Specifically, the undersigned have reviewed and are fully aware of <br />the costs and the allocation of costs in this project.
