The ordinance <br />was entitled Section 916. "FP" Floodplain District. <br />Our review determined that the ordinance could be clarified somewhat in the <br />following manner: , <br />1. In Section 902. Definitions 010. Application A. 10. Basement, in order to <br />be considered a "basement" as in contrast to a "lowest floor" for insurance <br />purposes, it must be below grade on all four sides. <br />We anticipate that you agree to make these amendments to the draft ordinance <br />prior to holding the public hearing. Consequently, on behalf of the <br />Commissioner of Natural Resources, I hereby conditionally certify state approval <br />of the above cited draft ordinance in accordance with Minnesota Statutes, <br />Section 103F. <br />This approval is valid upon receipt (within 90 days) of three (3) certified, <br />signed copies of the formally adopted ordinance (including the necessary <br />revisions cited above) and a completed copy of the Ordinance Certification <br />Checklist (attached) by Area Hydrologist Molly Shodeen located at the following <br />address: <br />DNR - Division of Waters <br />1200 Warner Road <br />St. Paul, MN 55106 <br />772 -7910 <br />Any changes of the subject draft ordinance prior to adoption (other than those <br />cited above) must be approved by this agency prior to adoption before they can <br />be considered valid.
