CONTRACT FOR FIRE PROTECTION 1992 CITY OF LITTLE CANADA RAMSEY COUNTY, MINNESOTA WHEREAS, the City of Little Canada is authorized by law to provide fire protection for all of the property in said City, and WHEREAS, the Little Canada Fire Department, Incorporated, is a volunteer Fire Department, operating as a non - profit association under the laws of the State of Minnesota and owns certain fire equipment, trucks, etc. for fighting fires, NOW, THEREFORE, the City of Little Canada and the Little Canada Fire Department, Incorporated, hereinafter referred to as the City and the Corporation, respectively, in consideration of the following provisions and covenants, do hereby enter into this contract and agreement on the day and date hereunto subscribed. 1. The City hereby engages the services of the Corporation to answer fire calls and fight fires and generally to provide fire protection to public and private property within the City of Little Canada for a period of one (1) year commencing January 1, 1992 and terminating December 31, 1992. 2. The Department agrees to answer all fire calls directed to it by the public for assistance in fighting fires of any nature and description within the legal limits of the City. 3. The Department will provide First Responder level services in connection with hazardous materials incidents. In addition, the City has contracted with the City of St. Paul to provide response for containment and securing of hazardous materials incidents occurring within the City of Little Canada. The annual fee for this contract is to be passed on to the City as a portion of the amount included in Item 4. All costs above and beyond this fee shall be reimbursed by the City. 4. The City agrees to pay to the Corporation for its services during the period above specified, and the Corporation agrees to accept as full remuneration for its services during the said period, the sum of $140,356.00 (One Hundred Forty Thousand, Three Hundred Fifty -Six and no /100) payable in fourths with the first payment due upon the execution of this Contract. Subsequent payments to be due on April 1st, July 1st, and October 1st. 5. The Department shall fully and completely report all facts, information, and data required by the City as specified on the form to be provided by the City for that purpose, and such form shall be subscribed by the Chief or other officer of the Corporation who was in charge and present at the fire so reported. 6. The City assumes no responsibility hereby for any acts of the Department, nor for any injuries or losses to members or to the equipment or trucks of the Department; and the Department hereby Page 3
