Hanson <br />TO: Mayor Ray Hanson and Members of the Council <br />FROM: Joel Hanson, City Administrator <br />DATE: January 3, 1992 <br />RE: Clean -up of Structure at 2620 Rice Street <br />After the fire last summer, contact was initiated with the <br />owner of the structure at 2620 Rice Street regarding it's <br />clean -up. On September 20, we sent the owner an agreement <br />whereby the City would be able to go in and demolish the <br />property without having to go through the complete <br />Hazardous Building Statutes which would incur attorney's <br />fees at the expense of the owner. On December 3, the owner <br />indicated to me that they were still awaiting the report <br />from the State Fire Marshal so that they could decide how <br />to proceed. I emphasized to them our need to get this <br />structure cleaned up as soon as possible. <br />On Friday, January 3, 1992, I contacted the owner's <br />attorney and he indicated to me that he would recommend to <br />the owner that the agreement be executed for the razing of <br />this structure. He acknowledged the fact that by the <br />voluntary signing of the agreement, costs would be saved by <br />the owner. <br />We hope to have the executed agreement in hand prior to <br />Wednesday's meeting. Should we not be in receipt of the <br />agreement by the end of next week, I would like the Council <br />to authorize us to proceed under the Hazardous Building <br />Statutes for the razing of the structure. This <br />authorization would give the City Attorney's the ability to <br />take the necessary steps should we not receive the <br />voluntary agreement. <br />Page 16 <br />
