RESOLUTION FOR VACATING PORTION OF <br />ORIGINAL SUNRISE DRIVE CUL -DE -SAC <br />WHEREAS, <br />A majority of the owners of property abutting the original Sunrise <br />Drive cul -de -sac have requested the City Council in a petition to <br />vacate a portion of that cul -de -sac according to law; <br />AND WHEREAS, <br />A public hearing was held on September 9, 1992 before the City <br />Council in the city hall on such petition after due published and <br />posted notice had been given, as well as personal notice to affected <br />property owners by the City Administrator on August 27, 1992 and all <br />persons interested were given an opportunity to be heard; <br />AND WHEREAS, <br />Any person, corporation, or city owning or controlling easements <br />contained upon the property vacated, reserves the right to continue <br />maintaining the same or to enter upon such way or portion thereof <br />vacated to maintain, repair, replace, remove or otherwise attend <br />thereto: <br />AND WHEREAS, <br />It appears that it will be in the best interest of the City to <br />approve such petition; <br />NOW, THEREFORE, BE IT RESOLVED, that such petition is hereby granted <br />and the property described as follows is hereby vacated: <br />Description of Sunrise Drive to be vacated: <br />That part of Sunrise Drive as platted in Gervais Ridge Addition, <br />Ramsey County, Minnesota, which lies outside the two lines <br />parallel with and 25 feet left and right of the centerline of <br />said Sunrise Drive and its northerly extension. <br />Description of Utility Easement to be vacated: <br />The 10 foot utility easement adjoining the 50 foot radius <br />cul -de -sac on Sunrise Drive as platted in Gervais Ridge Addition, <br />Ramsey County, Minnesota. <br />Reserving public utility easements 10 feet in width over and <br />across that part of the above vacated premises which lies between <br />two parallel lines respectively 25 feet and 35 feet to the left <br />and which lies between two parallel lines respectively 25 feet <br />and 35 feet to the right of said centerline of Sunrise Drive and <br />its northerly extension. <br />Page 23 <br />
