MINUTES <br />PLANNING COMMISSION <br />AUGUST 13, 1992 <br />ADJOURN <br />The City Planner reported that Slumberland complied <br />with exactly what was required of them on their last <br />building. The Planner agreed, however, that <br />landscaping was not maintained as it should have been. <br />The Planner thought it would be arbitrary to deny the <br />request for additional semi - trailer parking because the <br />City does not like Slumberland because they have not <br />taken great care of their property. The Planner did <br />indicate that the Planning Commission took proper <br />action in tabling the Slumberland application in order <br />to give them an opportunity to live up to Code <br />requirements and to give the Commission further time to <br />investigate. The Commission's has power in delaying a <br />matter to make sure that past promises are kept. <br />Herkenhoff pointed out that Slumberland has not acted <br />in good faith in the past. <br />The Planner was concerned about instructing a developer <br />to work with the neighbors on cleaning up a property so <br />that the neighbors will not argue about the proposal <br />for semi - trailer parking. The Planner stated that it <br />is not proper to approve a CUP because the neighbors <br />now like a developer. The Planner felt that a CUP <br />should be approved if it meets Code requirements. <br />Herkenhoff felt the issue comes down to code <br />enforcement. <br />Drabik felt that if better code enforcement was being <br />done a lot of these problems would not exist. <br />Carson explained the new code enforcement program that <br />has been undertaken by the Building Official, whereby <br />drive -by inspections of each property in the City will <br />be made. Code violations will be identified, and <br />property owners will be given a certain amount of time <br />to correct violations. <br />The City Planner felt it was impossible for the City to <br />identify and address all Code violations in the City <br />based on existing staffing. The Planner indicated that <br />not all property owners will not correct code <br />violations just because they are asked to do so. <br />Herkenhoff recommended that the meeting be adjourned. <br />Motion seconded by Garske. <br />Motion carried 7 - 0. <br />There being no further business, the meeting was <br />adjourned at 9 P.M. <br />e5ec. ul �� bmitted, <br />thy I .nzer, Re'. ding Secretary <br />Page 10 <br />
