Hanson <br />During my continuing discussions with Staff at the St. Paul <br />Board of Water Commissioners, it appears that a <br />satisfactory resolution will be forthcoming regarding the <br />termination provisions in the agreement related to the <br />construction of our Water Works Trail. It has been <br />indicated to me that the revision will essentially state <br />that the Board can cancel the agreement subject to the <br />provisions of notice provided in our original contract with <br />the St. Paul Board of Water Commissioners. This situation <br />provides us with 60 days to correct any deficiencies which <br />may exist after notice. Should they not be corrected, the <br />Board can then cancel the agreement and we would be <br />required to bear the cost in removing the trail if so <br />ordered by the Water Board. <br />If this language is in fact forthcoming, it would be my <br />recommendation that we can proceed with the award of the <br />contract for the construction of the Water Works Trail. I <br />expect to have the re -draft in my hands by Wednesday's <br />meeting. <br />Page 105 <br />< .10 <br />
