Hanson <br />RE: Water Works Trail Agreement <br />In negotiating the Eighteenth Rider to the Agreement <br />related to the construction Water Works Trail, I felt the <br />Staff of the St. Paul Water Utility and I had reached an <br />agreement as to the provision relating to the Board's right <br />to termination. Specifically, they were to utilize the <br />language set up in the original contract whereby we would <br />be notified of any concerns or violations which existed and <br />be given the opportunity to correct them before termination <br />proceedings would begin. <br />Attached is a copy of the proposed language that has been <br />forwarded to us for signature. This language does not <br />provide the City with the chance to correct any <br />deficiencies. Rather, the City has only been provided an <br />opportunity to appear at the Board Meeting for the purpose <br />of discussing the proposed termination. It is my opinion <br />that this language poses too many potential risks to <br />justify the expenditure of funds for installation of the <br />trail. <br />I discussed this matter with Mr. Stephen Schneider of the <br />St. Paul Water Utility. Attached is his letter dated <br />October 6, 1992 which responds to my concerns. As you will <br />note, the Board of Water Commissioners apparently had some <br />additional concerns they feel need to be addressed by the <br />language proposed. <br />It is my opinion that we should appear before the Board of <br />Water Commissioners in an attempt to rectify this problem. <br />I feel the language in this agreement should provide us <br />with the opportunity to correct any deficiencies before a <br />termination process could be commenced. If you are in <br />agreement with this, I would like authority to go before <br />the Board of Water Commissioners to discuss this matter. <br />Page 36 <br />
