14. WAC and SAC charges shall be paid with each building permit. <br />15. Park dedication fees shall be paid at the time of the building permit application for <br />each lot within the development based on the fee in effect at the time of the building permit <br />application. In addition, all plumbing permit fees, electrical permit fees and any other permit fees <br />required for new construction shall be paid at that time as well. <br />16. The Developer hereby agrees on behalf of itself, its heirs, successors and assigns, <br />that upon issuance of a Certificate of Occupancy the estimated market value for the next <br />preceding tax year as determined by the Ramsey County Assessor shall be no less than <br />$450,000.00. That until the earlier of (i) the date on which the Tax Increment District expires or <br />is otherwise terminated, or (ii) the date the applicable TIF Note is paid in full, no owner of a lot <br />which is subject to the terms of this Agreement shall seek administrative review or judicial <br />review of the applicability or constitutionality of any tax statute relating to the taxation of the <br />real property subject to this Agreement determined by any tax official to be applicable to the <br />development or the Developer or raise the inapplicability or constitutionality of any such tax <br />statute as a defense in any proceeding, including delinquent tax proceedings provided, however, <br />that `Tax Statute" does not include any local ordinance or resolution levying a tax. This shall <br />include but not be limited to the right to seek administrative review or judicial review of the <br />estimated market value for tax purposes of any tax parcel which is subject to this Agreement. <br />17. The Developer hereby agrees to the following schedule of lot purchases: a) on or <br />before December 31, 2013, the Developer shall have purchased 4 lots; b) on or before December <br />31, 2014, the Developer shall have purchased 10 lots; and c) on or before December 31, 2015, <br />the Developer shall have purchased 15 lots. <br />18. The Developer shall deposit with the City five thousand dollars ($5,000), from <br />which any and all costs and expenses incurred by the City, in any way related to this Contract, <br />116- <br />
