The amendment
proposed is the underlined wording in paragraph two of
Article 9.1.
MAYOR
Raymond G. Hanson
COUNCIL
Beverly Scalze
Jim LaValle
Steve Morelan
Bob Pedersen
ADMINISTRATOR
Joel R. Hanson
In researching this matter, I have come to the conclusion
that City Council approval of this type of amendment is not
required. Based on my review of State Statutes, a
conversation with our City Attorney, and the conversation
with Mr. Ben Pierce of the State Auditor's office who is in
charge of compiling information associated with fire relief
associations; it appears that the City Council need only
approve by -law amendments when they affect the financial
stability of the relief association. The primary area this
would involve would be pension increases requiring City
support.
Therefore, the Council may as a matter of record approve
the by -law amendment as presented. Otherwise, no action
appears necessary at this time. You may want the City
Attorney to confirm this conclusion at Wednesday's meeting.
JRH:kpv
Enclosure
Page 34
