Hanson, City Administrator
DATE: March 5, 1993
MAYOR
Raymond G. Hanson
COUNCIL
Beverly Scalze
Jim LaValle
Steve Morelan
Bob Pedersen
ADMINISTRATOR
Joel R. Hanson
RE: False Alarm Appeal
Attached is a letter received from Mr. Robert Pullman
relative to his appeal of a false alarm billing. You will
note that he is claiming we waive the fee because he did
not receive notice of the second and third false alarm. In
reviewing the files on this matter, it appears his
assertion is correct. In reviewing this matter with staff,
it appears we have not been sending out notices of the
second and third alarms due to the certified mail
requirement. As a result, we have prepared the Ordinance
Amendment which is addressed as an earlier agenda item.
Based on the reading of our existing ordinance and on the
fact that notice of the second and third false alarms was
not made, it is my recommendation that we waive the $50.00
fee based on the appeal request of Mr. Pullman. It should
be noted that I do not see any additional appeals for other
false alarm billings due to the fact that no appeal notices
were received in the required ten day period.
Should you have any comments or questions regarding this
matter, please advise me at your convenience.
Page 14
