City harmless from and against any and all costs, liability, <br />damages and claims of damage which may arise by reason of any <br />act of the Lessees or any of its employees, independent <br />contractors or agents, done in the performance or operation <br />under this Agreement, or any act on under pretended authority of <br />this Agreement. This indemnification shall include any costs <br />incurred by the City in defending any action involving an act by <br />the Lessees or any of its employees, independent contractors or <br />agents, and shall include any reasonable attorney's fees <br />incurred by the City. <br />9. City's Fund Raising Events. Lessees acknowledge that <br />the City conducts certain fund raising activities involving the <br />concession stand at Pioneer Park. In conjunction with the <br />City's fund raising activities, Lessees will allow the Little <br />Canada Recreation Association to use the concession stand and <br />any subsequent improvements as well as equipment for fund <br />raising events. Other organizations must make arrangements with <br />the City and Lessees for use of the stand. <br />10. Loss of Profits. The City is not liable for loss of <br />profits in the event the contract is cancelled, for any reason. <br />Lessees shall not be entitled to any future profits or damages <br />in the event that the City awards this contract to another firm <br />or retains the operation of the City activity at any time in the <br />future. <br />11.
