Hanson <br />Attached is the information relative to the Country Drive <br />assessments. You will note that there is a letter from Mark Malsam <br />asking the City to relieve him of the deferred portion of the <br />assessment. He will be present at Wednesday's meeting to discuss <br />this request. <br />In reviewing the assessment information, it appears that the <br />properties that were residential in nature are selling and becoming <br />commercial. Therefore, the assessment would be justified in those <br />cases. Depending on the action taken on the zoning request for Mr. <br />Malsam's property relative to Franklin Drywall, that property may <br />become commercial as well. If you assume that trend will continue, <br />then we should leave the assessment situation as is. <br />If we feel the property will remain residential in nature, then <br />perhaps a reconsideration of this matter is appropriate. Under our <br />new assessment policy, residential properties abutting a commercial <br />street would be assessed at a residential rate. However, it is also <br />important to note that we are retaining enough flexibility in our <br />policy that should a condition such as this exist, properties that <br />would have a commercial tendency would still be assessed at the <br />commercial rate. <br />Therefore, after reviewing the material enclosed, I am of the opinion <br />that the assessments should remain as adopted. If the Council feels <br />otherwise, then we would have to hold a new hearing to relevy the <br />assessment. The City Attorney will need to provide us with the <br />proper procedural requirements. <br />cc: Mark Malsam <br />Pa 63 <br />
