CITY OF LITTLE CANADA <br />RESOLUTION NO. 90- 10 -481A <br />RESOLUTION ADOPTING AND DEFERRING CERTAIN <br />SPECIAL ASSESSMENTS FOR IMPROVEMENT PROJECT NO. 89 -23, <br />COUNTRY DRIVE FROM THE WATER WORKS PROPERTY TO <br />SOUTH OWASSO BLVD. BY GRADING, SANITARY SEWER, STORM <br />SEWER, GRAVEL BASE BETWEEN THE SURFACE, AND CONCRETE CURB <br />AND GUTTER IN ACCORDANCE WITH MUNICIPAL STATE AID STANDARD <br />WHEREAS, <br />Pursuant to proper notice duly given as required by law, the City <br />Council has met and heard and passed upon all objections and <br />amendments to the proposed assessment for the improvement of Country <br />Drive from the Waterworks property to South Owasso Blvd. by grading, <br />sanitary sewer, storm sewer, gravel base between the surface and <br />concrete curb and gutter, in accordance with Municipal State Aid <br />Standards. <br />WHEREAS, <br />The City Council has determined that certain special assessments are <br />adopted and deferred as indicated on the attached Deferred Assessment <br />Roll relating to the real property described thereon. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LITTLE CANADA, MINNESOTA, THAT: <br />1. The Deferred Assessment Roll, a copy of which is attached hereto <br />and made a part hereof, is hereby adopted and approved and shall <br />constitute a deferred special assessment against the land named <br />herein, and each tract of land therein included is hereby found to <br />have received benefit by the improvement in the amount of the <br />deferred special assessment levied against it. <br />2. The special assessment shall be deferred, with interest accruing <br />on the amount of the special assessment, pursuant to Minnesota <br />Statutes Section 429.061, until the occurrence of one of the <br />following events: <br />a) Sale of the property or a portion thereof, or a final <br />plat of the property or a portion thereof has been <br />approved by the Little Canada City Council, or <br />b) Construction of any improvement on the property, or a <br />portion thereof, which shall be evidenced by the issuance <br />of a building permit by the City of Little Canada, or <br />c) A three year period elapses, concluding October 23, 1993. <br />Page 66 <br />
