Hanson <br />In researching past records, it has been determined that <br />Carley - Torgerson Surveyors prepared the property division <br />descriptions for the 1980 division of the Sculley property. <br />Carley - Torgerson Surveyors has no evidence in their files of having <br />prepared a road easement description for the road dedication that was <br />required at the time of the property division. As a result, there is <br />no indication that the City was at fault in not having the road <br />easement previously recorded. <br />Based on the City's present policy, we would recommend that Mr. <br />Sculley be responsible for the cost of dedication of the road <br />easement. Staff has also considered whether it was necessary to <br />require the road easement at this time due to the fact that when the <br />property develops, the easement could be obtained. However, given <br />the fact that existing properties would gain access to their rear <br />yard areas over this easement, it appears we should obtain the road <br />easement now.
