You will note from the September <br />12th letter from the Ramsey Tobacco Coalition attached, Little Canada's ordinance defines <br />electronic cigarettes as a nicotine and lobelia delivery device. As a result, any business selling <br />electronic cigarettes is required to have a Tobacco License. You will also note that while our <br />ordinance prohibits all indoor smoking in licensed tobacco retail establishments, there is some <br />question whether includes vaping lounges and /or sampling associated with vaping. <br />Also attached is information from the Public Health Law Center, the Tobacco Control Legal <br />Consortium, and the League of MN Cities on this issue. <br />In order to study this matter and bring a recommendation to the Council for consideration, staff is <br />recommending that the maximum number of tobacco licenses be decreased from twelve to ten at <br />this time. This license maximum had been set at twelve to cover the number of actual licenses <br />that had been issued. As part of the 2013 -2014 renewals, Gordies' Place and Moon Bay Liquor <br />did not renew their licenses; therefore, there are ten licenses issued at this time. <br />1 <br />
