JOINT POWERS AGREEMENT <br />BETWEEN RAMSEY- WASHINGTON METRO WATERSHED DISTRICT <br />AND THE CITY OF LITTLE CANADA <br />FOR ADMINISTRATION OF THE WETLAND CONSERVATION ACT (1991) <br />This agreement is made between the Ramsey - Washington Metro <br />Watershed District (District) and the City of Little Canada <br />(City), for administration of the Wetland Conservation Act of <br />1991 (WCA), pursuant to authorizing resolutions of the boards of <br />the District and the City. <br />This agreement is authorized by Minnesota Statutes section <br />471.59. <br />The District and The City agree that: <br />1. The District will act in place of the City as the local <br />government unit under the Wetland Conservation Act and the rules <br />of the Board of Water and Soil Resources adopted under the act. <br />2. The District will administer the WCA rules, MR Chapter 8420. <br />3. The District will follow the procedures identified in MR <br />Chapter 8420 regarding notices and hearings, and may collect any <br />necessary fees for the administration of the WCA rules from <br />permit applicants. <br />4. The District board managers will be the decision maker on <br />replacement plans. Or, it may delegate to staff the initial <br />decision making authority as well as that for exemptions, no -loss <br />determinations, and wetland banking. <br />5. Appeal of District decisions may be made to the joint powers <br />appeal board. The appeal board will consist of two managers <br />appointed by the District board, and two Council Members <br />appointed by the City. <br />6. There will be no cost to the City for District administration <br />of the WCA. <br />This agreement may be amended by mutual agreement of both parties <br />by resolutions of their respective boards. <br />This agreement shall become effective upon signature of all duly <br />authorized signatures, and shall remain in effect until <br />terminated by agreement of the parties or thirty days after <br />written notice of termination by either party to the order. <br />Roger Lake, President Date <br />Ramsey- Washington Metro Watershed District <br />Raymond G.
