1. The proposed action has been considered in relation to the <br />specific policies and provisions of and has been found to be <br />consistent with the official City Comprehensive Land Use Plan. <br />2. The proposed site is or will be compatible with the present <br />and future land uses of the area. <br />3. The proposed use conforms with all performance standards <br />contained herein. <br />4. The proposed use will not tend to or actually depreciate the <br />area in which it is proposed. <br />5. The proposed use can be accommodated with existing public <br />services and will not overburden the City's service capacity. <br />The proposal to construct an addition to an accessory garage, and <br />to construct an additional accessory garage on a two (2) acre <br />parcel will not impair light and air to adjacent properties, <br />increase congestion on roadways, increase the danger of fire or <br />public safety, or diminish property values. <br />The intent of the requirement to conditionally permit accessory <br />buildings that exceed 1,000 square feet in size, is to afford the <br />City some regulation on the use and placement of such structures. <br />Specifically, preventing illegal businesses from being run, <br />ensuring proper building materials are used, and adequate screening <br />from adjacent residential properties exists. <br />The purpose of the request is to build enough storage space, to <br />house the applicant's personal belongings such as a fishing boat, <br />a trailer, canoe, tractor, van, and cars. Currently many of these <br />items are stored outside. Therefore, the granting of the <br />conditional use permit will clean up the yard and appearance of the <br />lot. <br />The applicant is proposing to construct the new garage to the same <br />architectural characteristics of the existing garage and home. <br />As mentioned, the applicant is proposing to construct the new <br />garage 22 feet from the road right -of -way for Labore Road, <br />therefore, an eight (8) foot setback variance is also being <br />requested. <br />A variance from the specific requirements outlined in the City Code <br />shall not be granted unless it can be demonstrated that: <br />1. Special conditions and circumstance exist which are peculiar <br />to the land, structure, or building involved. Special <br />conditions may include exceptional topographic or water <br />conditions or, in the case of an existing lot or parcel of <br />record, narrowness, shallowness, insufficient area or shape of <br />2 <br />Page 41 <br />
