Auto body repair shares certain operational aspects with other I -P <br />uses, including a limited amount of interaction with retail service <br />customers. However, certain aspects of the existing auto body <br />repair facilities in Little Canada have led the City to exclude it <br />from its prime industrial district. It could be argued that the <br />primary issue with the use is not the use itself, but control of <br />the less desirable aspects. This is often accomplished through the <br />use of Conditional Use Permits. <br />Of concern in this specific application would be that if auto body <br />repair were included in the I -P District, Suburban would still not <br />be able to fully comply with the District standards. Although the <br />building is proposed to be remodeled and made closer to the <br />District standards, the project does not achieve the full 50% non- <br />metal exterior requirement. In addition, the outdoor storage on <br />the site exceeds the 75% limitation, and is not proposed to be <br />fully screened from residential uses and public rights -of -way. As <br />a result, although the use would be made conforming by the <br />amendment, the building would only be "less non- conforming ", and <br />the site would still not conform. <br />If the applicant is not able to fully comply at this time, one <br />option for the City would be to enter into a development agreement <br />with the owner under which additional improvements would be made <br />over time. This would help assure that the in exchange for <br />changing the Ordinance to accommodate the use, the City would be <br />receiving a conforming development, at least in the long term. <br />Under such an agreement, we could recommend approval of a text <br />amendment adding Auto Body Repair as a Conditional Use in the I -P <br />District, and the concurrent Conditional Use Permit. for Suburban <br />Auto's project. <br />If no agreement can be reached as to the extent or timing of long- <br />term improvements to bring the site fully into conformance, we can <br />not recommend approval of the text amendment or Conditional Use <br />Permit. <br />cc: Kathy Glanzer <br />Building Official <br />Dave Harris <br />Tom Sweeney <br />Dennis O'Connell <br />2 <br />Page 105 <br />
