Play for Hope, Hope to Play, Benefit Softball Tournament <br />Date: July 20, 1994 <br />To: Jim Moreland, Parks & Rec Department <br />-and - <br />Kathy & Little Canada City Council Members <br />From: Denise Windish, mother of Jeffrey Windish <br />-and - <br />Benefit Manager <br />Regarding: The use of Pioneer Park, for a Fundraiser <br />Dear Jim, Kathy & Council Members: <br />Thank you for taking the time to consider my request. This has been a <br />learning experience for all of us. The private use of Pioneer Park for a <br />Fundraiser with a Named Individual, raised issues requiring "NEW" policy <br />be written. And, for myself, I got quite an education in the Minnesota <br />Gambling Laws which govern this type of a Fundraiser. <br />With deepest regrets, I have to decline your generous offer to work with <br />me and make the Benefit a reality. The expense of meeting State, County & <br />City requirements; over - powers the potential for raising funds. <br />For future reference; anyone attempmting to do the same, will have to meet <br />the following requirements: <br />(01): Select & Register an Assumed Name to conduct business under. <br />(02): File Articles of Incorporation, under Chapter 317/317A as a Non - Profit <br />Organization. <br />(03): Publish the use of an Assumed Name & the Articles of Incorporation <br />in a local newspaper for 2 weeks. <br />(04): Obtain State Gambling Law on having a Fundraiser with a Named <br />Individual, use as a guideline. <br />(05): Obtain State Gambling Form, for Raffle Exculsion, if prizes offered <br />are less than $750.00 in a calendar year. <br />Note: If prizes are over $750.00 in a calendar year, a permit is needed <br />but, not obtainable without 3 years of filed tax returns. <br />(06): Obtain State Gambling Form, Family Bingo Exculsion, if prizes offered <br />are less than $100.00 per game, the amount per calendar year, was not <br />available at the time of my inquiry. <br />(07): Rules governing Softball Tournaments also apply, but where not prohibiting <br />or available at the time of my inquiry. <br />(08): Ramsey County Department of Health, governs Concession Sales and reqiures <br />a menu & food prep area inspection, before allowing a permit to be purchased. <br />(09): At the City level as we discussed; General Liability Insurance in the <br />amount of $1,000,000.00 with the City as Co- Benefactor, must be secured. <br />(10): A Vendor's Permit for token toy & gifts sales, must be obtained from <br />the city, in this case it's the City of Little Canada. <br />(11): If Beer Sales apply, which did with my request; then Liquor Liability • <br />Insurance is needed. Note: The Application & Permit for a 1 to 3 day <br />temporary On -Sale Liquor License states Insurance is not Mandatory? <br />But, at the amounts requested of me: $300,000/$100,000 personal injury, <br />$10,000 property damage and $300,000/$100,000 loss of means of support. <br />Proof of:-insurance must be provided with Application to City; who approves <br />or disapproves, collects fee's &'forwards application to State. <br />Page 11 <br />
