Hanson <br />Pursuant to our telephone conversation of June 28, 1994, I have discussed <br />the matter with the City Attorney. I told the City Attorney that you had <br />been advised not to sue the City over the garage permit matter. I also <br />told the City Attorney that you were willing to settle the matter with John <br />Ryan as long as the City waives its fees for the subdivision in order that <br />you may sell some property to Mr. Ryan and that you want your Attorney's <br />fees of approximately $7,000 reimbursed. <br />I need a couple of things clarified before presenting this matter to the <br />City Council. First, whom do you expect would pay your Attorney's fees? <br />Secondly, were you proposing this settlement as a condition of you not <br />suing the City or had you decided not to sue the City irrespective of the <br />decision regarding your settlement proposal? <br />Please document your proposal in writing addressing the two questions I <br />have listed above in order that I may review it with the City Council. <br />Because you have described this as a settlement proposal, documentation in <br />writing should exist outlining these settlement provisions in order for the <br />Council to take action.
