limitation, reasonable attorneys' fees and expenses, in any case, <br />to the extent permitted by law) so incurred, together with <br />interest thereon (to the extent permitted by law) from the date <br />on which such sums or expenses are paid or incurred by Landlord, <br />shall be paid by Tenant and rights of Landlord contained in this <br />Article 8 shall survive the expiration or earlier termination of <br />this Lease. <br />Section 8 03 Termination, Upon the occurrence of an Event <br />of Default, and at any time thereafter, Landlord may serve a <br />written notice upon Tenant that Landlord elects to terminate this <br />Lease upon a specified date not less than ten (10) days after the <br />date of the serving of said notice and, unless such default shall <br />be remedied prior to the termination date set forth in Landlord's <br />notice to Tenant (to the extent this Lease allows such defaults <br />to be cured), this Lease shall then expire on the date so <br />specified in Landlord's notice to Tenant, and Tenant will then <br />quit the Premises and surrender possession thereof to Landlord. <br />section 8.04. Surrender. Upon any expiration or termination <br />of this Lease, Tenant shall quit and peacefully surrender the <br />Premises to Landlord and Landlord and its agents may immediately, <br />or at any time after such default or after the date upon which <br />this Lease and the Term shall expire and come to an end, re -enter <br />the Premises without notice, either by summary proceedings, or by <br />any other applicable action or proceeding or otherwise, and may <br />repossess the Premises and dispossess Tenant and any other <br />persons from the Premises and remove any and all of their <br />property and effects from the Premises. <br />ARTICLE TX <br />ASSIGNMENT AND SUBLETTING <br />Tenant shall not assign, sublease, convey, mortgage, <br />encumber, alienate, sell, exchange or in any manner transfer all <br />or any part of its interest in this Lease or the Premises to any <br />third party without Landlord's prior written consent. <br />ARTICLE X <br />MISCELLANEOUS <br />Section 10.01. Accord and Satisfaction, No payment received <br />by Landlord of a lesser amount that the Rent or other charges due <br />hereunder shall be deemed to be other than on account of the <br />earliest stipulated rent or other charges nor shall any statement <br />on a check or any letter accompanying a payment of rent or other <br />charges be deemed an accord and satisfaction.
