Hanson <br />The Council had asked staff to forward the issue of tax forfeited <br />property on County Road B2 to the Parks and Recreation Commission <br />for their recommendation. On a 3:2 vote, the Commission <br />recommended that the City retain the property for wetland and <br />open space purposes. During their discussion, they raised a good <br />point relative to any other parties interest in a wetland parcel. <br />If no one else is interested, the parcel will stay in trust <br />exempt status and continue as a wetland. When one further <br />considers today's wetland regulations, it is unlikely that the <br />property could be used for other purposes as long as a wetland <br />designation exists. <br />Based on our past actions, I had recommended that we retain that <br />land for wetland purposes. However, given those comments and the <br />concern for maintenance and liability issues, perhaps it is <br />better that the City not acquire title through tax forfeiture <br />proceedings. It also appeared that the Parks and Recreation <br />Commission did not have a definite plan for this area. Assuming <br />the property did stay in trust exempt status, I believe the City <br />could acquire it in the future should a need ever arise. <br />Therefore, the Council may want to consider this matter further <br />before acting on the Parks and Recreation Commission's <br />recommendation. <br />JRH:kpv <br />cc: Parks & Recreation Commission <br />Jim Morelan, Parks & Recreation Director <br />Page 206 <br />
