CITY OF LITTLE CANADA <br />RESOLUTION NO. <br />A RESOLUTION ESTABLISHING A SEPARATE ACCOUNT FOR CABLE <br />FRANCHISE FEES AND SPECIFYING THAT THE FUNDS IN THIS ACCOUNT MAY <br />ONLY BE USED FOR CABLE - RELATED ACTIVITIES <br />WHEREAS, the City of Little Canada is a member of the North <br />Suburban Cable Communications Commission, which was established <br />by a Joint and Cooperative Agreement between the Cities of Arden <br />Hills, Falcon Heights, Lauderdale, Little Canada, Mounds View, <br />New Brighton, North Oaks, Roseville, St. Anthony and Shoreview, <br />pursuant to Minnesota Statutes Section 471.59; and <br />WHEREAS, the Grantee of the cable franchise pays franchise <br />fees to the City; and <br />WHEREAS, the cable subscriber ultimately bears the cost of <br />the franchise fees and ought to be the beneficiary of their use, <br />either in cable franchise administration or in community cable <br />television programming; and <br />WHEREAS, Article X, Section 3, of the Joint and Cooperative <br />Agreement states that, after making its annual contribution to <br />the budget of the North Suburban Cable Communications Commission, <br />the remainder of any franchise fee paid to the Member by the <br />Grantee shall be used for cable- related expenses; and <br />WHEREAS, the North Suburban Cable Communications Commission <br />does, from time to time, make available grants to assist the <br />Member Cities with the purchase of video equipment to be used for <br />programming the municipal access channel and to assist cities <br />with the costs of producing a specific program or series of <br />programs; and <br />WHEREAS, in order to be eligible for such grants, a Member <br />City must be able to document that its franchise fees and <br />specifying that the funds in this account may only be used for <br />cable - related activities; <br />NOW, THEREFORE, BE IT RESOLVED by the City of Little Canada: <br />1. That the City will establish a separate account for <br />franchise fees, or their equivalent. <br />2. That expenditures from this separate account will be <br />restricted to cable - related activities. <br />3. That cable - related activities are defined as: <br />Page 6 <br />
