(2) If more than six (6) -- Fnkne-- (-9-)f false alarms relating to the operation of a burglar alarm have been reported in any calendar year, commencing January 1, 1994, the user fee shall be Two Hundred Dollars ($200.00) — FOne- - -Hundred---- F -rft -t Dollars -• ($150 tff)-j- for each such false alarm. (B) An alarm user, whose alarm system has resulted in the reporting of three (3) - Ffour-- (4 -)- }- or more false alarms because of the operation of a fire alarm, shall be charged the following user fees: (1) If three (3) [-four-- -(4r]- through four (4) [six- (6))-false alarms relating to the operation of a fire alarm have been reported in any calendar year, commencing January 1, 1994, the user fee shall be Two Hundred Fifty Dollars ($250.00) for each such false alarm. (2) If more than four (4) -Es-i (6) 9 false alarms relating to the operation of a fire alarm have been reported in any calendar year, commencing January 1, 1994, the user fee shall be Five Hundred Dollars ($500.00) for each such false alarm. 816.050. NOTICE. Upon notice of the first false alarm report for a particular alarm system, the City Administrator or his /her designee - (-Clerk)- shall, by regular mail, notify the alarm user that a false alarm has been reported. The City Administrator or his /her designee -(-ererk)- shall verify the day of mailing by filing an affidavit of mailing in the City records. The notice shall include a copy of the City's false alarm regulations. After receipt of the second and subsequent false alarm reports for a particular alarm system, the City Administrator or his /her designee - (Clerk+ shall notify the alarm user of each alarm report by regular mail, with affidavit of mailing, and the City Administrator or his /her designee (C- Jerk) - shall inform the alarm user if a user fee is payable. If a user fee is payable pursuant to Section 816.040, the fee must be paid to the City finance department within fifteen (15) days of the date of mailing of the notice, or the alarm user must file a written notice of appeal with the City Administrator or his /her designee - eale-r-k)— within fifteen (15) days of the date of mailing of the notice. 816.060. APPEAL. User fees which have been appealed shall initially be reviewed by the City Administrator or his /her designee. Should the appealant not agree with the decision rendered by the Administrator, the appeal shall be reviewed by the City Council -(be— reviewed --by- the City Council). The alarm user shall be invited to appear before the City Council. If the alarm user is not present when the Council reviews the appeal, the City Administrator or his /her designee - (e1erk }- Page 53
