10/08/93 <br />MAINTENANCE AGREEMENT <br />REGARDING BUS SERVICE, BUS ZONES, <br />AND BUS STOP SIGNS <br />THIS AGREEMENT is made this _ day of , 1993, by and between the <br />Metropolitan Transit Commission ( "MTC "), a political subdivision of the State of Minnesota, <br />and the City of , a Minnesota municipal corporation, (hereafter "City "). <br />WITNESSETH THAT: <br />WHEREAS, MTC has historically worked cooperatively with metropolitan <br />municipalities in locating, erecting and maintaining bus stop signs and shelters throughout the <br />Twin Cities metropolitan area; and <br />WHEREAS, the spirit of cooperation has greatly facilitated MTC efforts to better <br />serve its customers, the cities and their residents; and <br />WHEREAS, the MTC and the cities are concerned about liability and other issues that <br />may arise from their cooperative efforts; and <br />WHEREAS, the MTC and the City wish to reflect their understandings in this <br />Agreement as to the location of bus stops, the erection and maintenance of bus stop signs, <br />and the location, construction, and maintenance of bus shelters; <br />NOW, THEREFORE, in consideration of the mutual covenants set forth below, the <br />parties hereto agree to the following terms, covenants and conditions: <br />1. Responsibilities of the MTC and the City. <br />a. Location of Bus Stops. The MTC shall be responsible for selecting locations <br />for bus stops and bus stop signage. Prior to locating any new bus stops in the <br />City, the MTC shall make a determination that the bus stop is in substantial <br />compliance with the locational standards set forth in Exhibit A, attached hereto <br />and incorporated herein by reference. The final determination as to bus stop <br />locations shall be made by the MTC. The MTC shall survey existing bus stop <br />locations and advise the City as to whether such locations are in compliance <br />with the Exhibit A locational standards. <br />7/22003688 10/8/93 <br />The City and the MTC shall coordinate and consult as to the <br />formulation of a plan for providing access to the new bus stops in accordance <br />with the applicable provisions of the Americans With Disabilities Act of 1990, <br />standards for which are currently set out in the Federal Register, Vol. 56, No. <br />Page 112 <br />
