this Ordinance are substandard uses. However, <br />structural alterations which substantially increase <br />the substandard dimension may not be allowed. <br />a) Deck additions may be allowed without a <br />variance to a structure not meeting the <br />required setback from the ordinary high water <br />level if all of the following criteria and <br />standards are met: <br />1. The structure existed on the date the <br />structure setbacks were established; <br />2. A thorough evaluation of the property and <br />structure reveals no reasonable location <br />for a deck meeting or exceeding the <br />existing ordinary high water level <br />setback of the structure; <br />3. The deck encroachment toward the ordinary <br />high water level does not exceed fifteen <br />(15) percent of the existing setback of <br />the structure from the ordinary high <br />water level or does not encroach closer <br />than thirty (30) feet, whichever is more <br />restrictive; and <br />4. The deck is constructed primarily of <br />wood, and is not roofed or screened. <br />4. Prohibited Uses. Any uses which are not permitted <br />or conditional uses as regulated by the applicable <br />zoning district underlying this Shoreland District <br />as indicated on the official Zoning Map of the <br />City. <br />917.030 ZONING PROVISIONS <br />A. The following standards shall apply to all shorelands of <br />the protected waters listed in Section 917.020 of this <br />Ordinance within the City. Where the requirements of the <br />underlying zoning district, as shown on the official <br />Zoning Map, are more restrictive than those set forth <br />herein, then the more restrictive standards shall apply: <br />26 <br />Page 53 <br />
