GRANT OF PERMANENT DRAINAGE AND UTILITY EASEMENT <br />THIS AGREEMENT, made this A/ day of January, 1994, by and <br />between Breckenridge Associates, a Minnesota General Partnership, <br />Grantor, and the City of Little Canada, a municipal corporation under <br />the laws of the State of Minnesota, Grantee; <br />WITNESSETH, that the said Grantor, in consideration of One and <br />No /100 Dollar ($1.00) to them in hand paid by said Grantee, and for <br />other good and valuable consideration, the receipt of which is hereby <br />acknowledged, hereby grant to said Grantee, its successors and <br />assigns, the following described property in perpetuity for drainage <br />and utility purposes, and for ingress and egress at any and all times <br />with all machinery, equipment, and materials necessary for the <br />aforesaid purposes, over, under and across the westerly 30.00 feet of <br />the following described property owned by Grantor and situated in <br />Ramsey County, Minnesota. <br />Beginning on the south line of Yorkton Court 308.67 feet east of <br />the east line of Yorkton Boulevard; thence south parallel to said <br />Yorkton Boulevard 286.67 feet; thence east parallel to the south <br />line of Yorkton Court 415.00 feet; thence north at right angles <br />to the southwest line of the Water Works Right -of -Way; thence <br />northwesterly thereon to the north line of South Half of South <br />east Quarter of the Northwest Quarter; thence west on said north <br />line to intersect Yorkton Court cul -de -sac; thence southerly and <br />westerly around said cul -de -sac to the south line of Yorkton <br />Court; thence west thereon to beginning in the South Half of the <br />Southeast Quarter of the Northwest Quarter of Section 6, Township <br />29, Range 22. <br />TO HAVE AND HOLD said Easement unto said Grantee and its <br />assigns.
