1. The proposed action has been considered in relation to the <br />specific policies and provisions of and has been found to be <br />consistent with the official City Comprehensive Land Use Plan. <br />2. The proposed site is or will be compatible with the present <br />and future land uses of the area. <br />3. The proposed use conforms with all performance standards <br />contained herein. <br />4. The proposed use will not tend to or actually depreciate the <br />area in which it is proposed. <br />5. The proposed use can be accommodated with existing public <br />services and will not overburden the City's service capacity. <br />Zoning. The subject site is zoned B -3, General Business District, <br />which allows convenience gasoline operations as a conditionally <br />permitted use. Therefore, the proposed use is an acceptable use of <br />the property under certain conditions found necessary by the City <br />of Little Canada. <br />Setbacks. As outlined below, the proposal meets all of the setback <br />requirements as outlined within the City Code. <br />Required Proposed <br />Front (street) 40' 70' <br />Front (canopy) 20' 30' <br />Side 0' 5' <br />Side 0' 5' <br />Building Height. City Ordinance prohibits buildings within the B- <br />3 zoning district from exceeding three (3) stories, or thirty -six <br />(36) feet in height, which ever is less. The proposed building <br />will be one story, therefore, complies with the Zoning Ordinance. <br />Landscaping /Buffering. The applicant is proposing extensive <br />landscaping along the North and West property lines, consisting of <br />eighty -three (83) Mint Julep Junipers, six (6) Colorado Spruce, ten <br />(10) Crab Trees, and three (3) Skyline Honey Locust Trees. These <br />trees will serve as a buffer to the adjacent commercial properties <br />to the North and West. The entire perimeter boulevard will be <br />sodded, and six (6) Red Splendor Crab trees will be planted along <br />Country Drive and Little Canada Road. The existing retaining wall <br />along the North and West property lines will remain. There appears <br />to be mechanical equipment in the rear of the building which is to <br />be screened with a six (6) foot tall wooden fence. The applicant <br />should provide greater detail in regards to the design of the fence <br />and the mechanical equipment. <br />Page 29 <br />
