340AA05 LIQUOR 7998 <br />Subd. 4. Temporary off -sale licenses; wine auctions. (a) The governing body of a <br />city may issue a temporary license for the off -sale of wine at an auction with the <br />approval of the commissioner. A license issued under this subdivision authorizes the <br />sale of only vintage wine of a brand and vintage that is not commonly being offered <br />for sale by any wholesaler in Minnesota. The license may authorize the off-sale of wine <br />for not more than three consecutive days provided not more than 600 cases of wine are <br />sold at any auction. The licenses are subject to the terms, including license fee, imposed <br />by the issuing city. Licenses issued under this subdivision are subject to all laws and <br />ordinances governing the sale of intoxicating liquor except section 340A.409 and those <br />laws and ordinances which by their nature are not applicable. <br />(b) As used in the subdivision, "vintage wine" means bottled wine which is at least <br />five years old. <br />Subd. 5. [Repealed, 1990 c 554 s 22] <br />Subd. 6. Airports commission. The commissioner shall approve the license if the estab- <br />lishment has complied with sections 340A.402; 340A.409; 340A.410, subdivisions 4, <br />5, and 7; 340A.412, subdivisions Ito 7, 9, and 10; 340A.413; 340A.501; 340A.502; <br />340A.503; 340A.504; and 340A.505. An establishment issued a license under this sub- <br />division is not required to obtain a license from any municipality, county, or town. <br />History: 1985 c 308 s 2; 1Sp1985 c 16 art 2 s 3 subd 1; 1987 c 152 art I s 1 <br />340A.406 INTOXICATING LIQUOR; COMBINATION LICENSES. <br />A city of the fourth class or a statutory city of 10,000 or fewer population may issue <br />an off-sale and on -sale intoxicating liquor license to the same licensee or, in lieu of issu- <br />ing on -sale and off-sale licenses separately to a licensee, may issue a combination on- <br />sale and off-sale license. A city may continue to issue licenses under this subdivision <br />when the population of the city exceeds 10,000 population. <br />History: 1985 c 305 art 6 s 6; 1987 c 152 art 1 s 1 <br />340A.407 COMMON CARRIERS. <br />The commissioner may issue an on -sale license to a person certificated by either <br />the state or the United States of America, or an agency thereof, as a common carrier <br />engaged in the business of transporting persons for hire in interstate or intrastate com- <br />merce to sell intoxicating or nonintoxicating malt liquor in a place where meals are <br />sold.
