outside regular patrol hours at the specific request of the City's Police <br />Department. ACSI shall respond immediately to any call involving a bite <br />case or injured animal reported through the Police Department. <br />6. ACSI represents and agrees that all animals impounded shall be <br />kept at White Bear Kennel, 1283 Hammond Road, White Bear Lake, MN 55110. <br />ACSI agrees and warrants that all animals impounded shall be kept in a <br />comfortable and humane manner for a period required by the City ordinance. <br />It is mutually agreed that ACSI may temporarily board at an emergency <br />facility if access and /or treatment is not immediately available at the <br />contract facility. <br />7. At the time that an animal impounded under this contract is <br />reclaimed, ACSI or its agent shall collect the impounding fee as provided <br />by City ordinance. ACSI shall furnish monthly reports to the City as <br />required as to the service or services rendered in connection with each <br />animal impounded. All impounding fees and /or any other penalty fees <br />collected by ACSI or its agent shall be remitted to the City. ACSI shall <br />retain all boarding charges when animals are reclaimed. <br />8. In the event an animal impounded and boarded by order of the City <br />Health Officer or placed under quarantine by ruling of the State Board of <br />Health, said animal shall be boarded as required by said order or ruling. <br />At the end of such period, the City releases all of its interest, right and <br />control over said animals which may then be disposed of at the discretion <br />of ACSI. All proceeds from the disposition of such animals may be retained <br />by ACSI including any proceeds received from animals disposed of in <br />accordance with Minnesota Statutes 35.71. <br />9. The City shall furnish to ACSI any special forms or receipts <br />specified in the City ordinance and ACSI shall keep the records of all <br />animals impounded together with a description of the same. <br />10. ACSI shall assume liability for all harm to animals due to the <br />-2- <br />Page 13 <br />
