provided by the Consultant under this Agreement shall be of the expected <br />standards of the Engineering Profession and that all employees of the <br />Consultant assigned to the various phases of work on this Project shall be <br />experienced and qualified for the work to be done. <br />5.2. It is understood that the Consultant's assignment of on -going <br />personnel to the City's account was a vital consideration relating to the <br />retention of the Consultant. Therefore, the Consultant shall endeavor to <br />maintain said personnel assignment so long as reasonably practical for the <br />duration of this Agreement. No change in the assignment of the designated <br />"City Engineer" shall be made by the Consultant without the expressed <br />consent of the City. However, should the City not be satisfied with the <br />current personnel assignment, it may request the Consultant to re- assign <br />personnel to its account subject to final approval by the City. Should a <br />change in personnel result from whatever reason, the hourly rate for the <br />newly assigned person shall be the lesser of the newly assigned person's <br />normal rate category or of the category of the person replaced. In consideration of the City's execution of this Agreement, the rates <br />listed in Schedule "B" attached to this document will be in full force and <br />effect for the calendar years 1994 -1998. They may be adjusted upward on <br />January 1st of each year by no more than the increase in the Consumer Price <br />Index (CPI) for last calendar year or calculated for the Twin City <br />Metropolitan Area. Written notice of said adjustment shall be provided by <br />the Consultant to the City and be made a part of this Agreement. <br />5.4. The Consultant will prepare Drawings, Specifications and other <br />documents in a timely manner, but it is hereby agreed that the Consultant <br />cannot be held responsible for delays occasioned by factors which are <br />beyond his control, nor by factors which could not reasonably have been <br />Page 92 <br />
