WHEREAS, City is undertaking public improvements to serve said Plat consisting of <br />water, sanitary sewer, grading, drainage, curb & gutter, and streets pursuant to Improvement <br />#13 -08 and will levying special assessment against the lots in Pine Tree pond for these <br />improvements totaling $855,000, and <br />WHEREAS, Developer proposes the construction of certain other improvements within <br />said Plat. Said other improvements include the general improvements to serve the Plat <br />(hereinafter individually and collectively referred to as the "Required Improvements "), and <br />WHEREAS, the Developer has prepared final plans and specifications for the Required <br />Improvements, and <br />WHEREAS, the City believes that the Development of the Plat and fulfillment of this <br />Agreement are vital to the best interest of the City of Little Canada. <br />NOW THEREFORE, the City and Developer agree as follows: <br />Contract <br />1. The Developer shall cause to be constructed, at his cost, the Required <br />Improvements (stated in Paragraph #25 below) according to City standards. All of the Required <br />Improvements shall be approved by the City and shall be consistent with approved Plat, the <br />Grading Drainage and Erosion Control Plan, Tree & Pond Planting Plan, Landscaping Plan, the <br />Development Utility Plan, and City Resolution Number 2013 -4 -64 and any City resolution <br />associated with final plat approval granted on April 24, 2013, as well as any requirements <br />imposed by the City Engineer. A copy of the subdivision plat is attached hereto and <br />incorporated herein as Exhibit A. <br />2. The Developer shall have no claim against the City and its officers and employees <br />for damages sustained or costs incurred resulting from Plat approval and development.
