restrictions: <br />(a) The following restrictions apply to premises licensed as a Tobacco Store: <br />(I) No person shall permit a minor to sample tobacco. <br />(2) No more than 50% of the gross revenue of the store may be derived from the <br />sale of tobacco-related devices. <br />(3) Smoking shall not be permitted and no person shall smoke within the indoor <br />area of any establishment with a retail tobacco license. Smoking tobacco, or <br />lighting and burning tobacco, for the purposes of sampling tobacco and <br />tobacco related products or smoking from a delivery, device is prohibited. <br />Notwithstanding the preceding, smoking may occur in a Tobacco Store if all <br />of the following circumstances are met: <br />i. The smoking is by a customer or potential customer for the specific <br />purpose of sampling tobacco; <br />ii. The Tobacco Store has held a license from the City to sell tobacco <br />products at that location for at least six months prior to the enactment <br />of this provision; and <br />iii. The owner of the establishment has maintained a valid license and <br />has abided by all applicable laws. <br />Any smoking allowed under this exemption shall be prohibited if the license <br />holder loses the license or transfers title to, relinquishes management or <br />control of, or sells the business to any other individual or business entity. <br />01_ Smoking from delivcry device tcxanv reason is strictly tolubitedin anti-. <br />Tobacco Store. <br />(b) The following restrictions apply to premises licensed for general tobacco sales and <br />display: <br />(1) <br />The establishment shall fully comply with the Minnesota Clean Indoor Air <br />Act, Minn.
