I assume JSC has an umbrella or higher base limits than $1,000,000. I need them
raised and ideally, $5,000,000 of coverage would be desirable.
2.6.5— I would think Professional Liability Insurance should be carried. However, if you currently don't have that as part
of your insurance package, let me know and we will figure something out.
3.2.10 — Modified wording to conform to representations at interview.
3.2.19 — Attempted to clarify how bidder interest is to be developed per our recent discussion.
3.3.12.4 — Deleted this as it provides too big an out on the CM's responsibility to ensure the project is delivered per
construction documents.
8.2 — Deleted Mediation
8.3 — Deleted Arbitration
9.4 — Modified to allow for notice and an opportunity to cure.
9.7 — Deleted — we would not be paying termination expenses if the termination is "for cause ".
10.1— Deleted the reference to arbitration.
12.0 - Added language about taking advantage of tax exempt status and that Contractor is not allowed to perform any
work on the job (bidding) and any incidental work shall be with the prior approval of the Owner's representative.
I'm forwarding it to our City Attorney for comment as well. If you have questions, let me know.
Thanks
Joel R. Hanson
City Administrator
(651) 766-4040
2
