GRANT OF PERMANENT EASEMENT THIS AGREEMENT, made this �J ''day of 6T ag , 197.1, by and between Levitz Furniture Company of the Midwest, Inc., a Colorado corporation, Grantor, and the City of Little Canada, a municipal corporation under the laws of the State of Minnesota, Grantee; WITNESSETH, that the said Grantor, in consideration of One and No /100 ($1.00) Dollars to them in hand paid by said Grantee, and for other good and valuable consideration, the receipt of which is hereby acknowledged, hereby grant and warrant to said Grantee, its successors and assigns, a permanent easement for drainage and utility purposes, and for ingress and egress tit—try and all tin c with all machinery, equipment and materials necessary for the aforesaid purpose, in, over, and upon the following described property owned by Grantor and situated in Ramsey County, Minnesota, which permanent easement is described as follows: Permanent Easement for Drainage and Utility Purposes: The West 10.00 feet of East 20.00 feet of the South 60.00 feet of the following described property: That part of the Southeast Quarter of Section 31, Township 30 North, Range 22 West, Ramsey County, Minnesota lying east of the west 61.15 feet thereof, and northerly of the Burlington Northern, Inc. right -of -way and southerly and westerly of the following described road easement: A road easement 35.00 feet easterly and northerly,, also a 25.00 foot road easement westerly and southerly, both adjacent to and along a line which is described as follows: Commencing at the south quarter corner of Section 31, Township 30 North, Range 22 West, Ramsey County, Minnesota; thence easterly along the south line of said Section 31, 821.08 feet; thence deflecting 86 degrees 04 minutes 45 seconds left, 416.99 feet to the point of beginning; thence continuing northerly, on the last Page 15
