Mr. Joel R. Hanson <br />November 11, 1994 <br />Page Two <br />will be entered on December 7, 1994. As a result, the Beckers <br />would be allowed until March 8, 1995 to file an appeal. Since <br />the Court's factual findings could not be overturned on appeal <br />unless clearly erroneous, we believe the chances of a reversal on <br />appeal are minimal. <br />Although this Order is not binding upon other Judges of the <br />Ramsey County District Court, we believe that the Order will be <br />of assistance to us in the event of future similar appeals. I <br />have forwarded a copy of this Order to William Peterson who is <br />preparing appraisals evaluating the benefit to abutting <br />landowners resulting from the proposed Lake Street Improvement <br />Project (93 -13) and the proposed Jackson Street /Old County Road <br />C /Lakeshore Avenue Improvement Project (93 -11). I will forward <br />his appraisals to you once they are completed. <br />I enjoyed working with you in this matter. Clearly, Judge <br />Faricy was impressed by your testimony as to the reasonableness <br />and fairness of the City's assessment policy.
