shall be assessed to the abutting property owners on a <br />based upon an 8 "/3" section is reasonable and <br />equitable. <br />13. The apportionment of the assessment was uniform and the <br />method used to apportion the assessment was not arbitrary or <br />unreasonable. <br />14. The Respondent is the prevailing party and shall be <br />entitled to recover costs incurred in this appeal pursuant to <br />Minnesota Statutes Section 429.081. <br />CONCLUSIONS OF LAW <br />1. The assessments against Appellants' property are <br />declared valid and Appellants' Appeal is hereby dismissed <br />2.
