Fahey <br />COUNCIL <br />Beverly Scalze <br />Jim LaValle <br />Steve Mercian <br />Bob Pedersen <br />ADMINISTRATOR <br />Joel R Hanson <br />St. Jude Medical, Inc. wishes to construct a new entrance sign at <br />their Lillehei facility adjacent to Viking Drive. (See map <br />attached.) The sign would be located on right -of -way turned back <br />to us from the State of Minnesota (Parcel 10). Due to zoning <br />regulations, St. Jude would need to acquire this property in <br />order to place their sign. To address this issue, the City <br />Attorney has concluded that we would need to vacate our interest <br />in the property. The property would then likely accrue to St. <br />Jude given that it appears it initially came from their parcel. <br />St. Jude feels this piece will return to them. However, that <br />fact cannot be warranted by us at this time. <br />To expedite this matter, it is my recommendation that we call for <br />a hearing to be held at our meeting on October 11, 1995. This <br />recommendation is subject to the understanding that St. Jude will <br />reimburse the City for the costs associated with this <br />transaction. These costs would include Attorney's fees, <br />publication, recordings, and surveying to define the legal <br />description for this parcel while still leaving us adequate <br />right -of -way for Viking Drive. <br />St. Jude has also requested that we vacate our interest in Parcel <br />9 indicated on the attached map in order that they can acquire <br />interest in it. I believe they want it to serve as a buffer to <br />their property to protect its aesthetic value. Given the size of <br />this parcel, the Council will need to provide direction as to how <br />they would like this issue to be handled. It was acquired by the <br />State through warranty deed without restriction as to use. <br />Therefore, it appears to be saleable without restrictions after <br />holding a vacation hearing. They key question here is should <br />there be compensation associated with the transfer of this <br />property? My recommendation would be that compensation should be <br />PAGE 146 <br />
