Granting the variance requested will not confer on the <br />applicant any special privilege that is denied by this <br />Ordinance to other lands, structures, or buildings in <br />the same district. <br />e. A genuine hardship exists in complying with the literal <br />terms of this Ordinance. <br />Ih all cases, we believe the property in question and the <br />applicant's proposal to qualify. Additionally, the variance <br />proposal appears to meet the stipulated tests imposed by the <br />zoning ordinance, these are: <br />a. Impair an adequate supply of light and air to adjacent <br />property. <br />b. Unreasonably increase the congestion in the public street. <br />c. Increase the danger of fire or endanger the public safety. <br />d. Unreasonably diminish or impair established property <br />values within the neighborhood, or in any way be contrary <br />to the intent of this Ordinance. <br />e. Violate the intent and purpose of the City Comprehensive <br />Plan. <br />Beyond the issue of Mr. Leibel's proposed lot development <br />and required variance, the proposed land division affecting <br />the balance of this area also contributes to a resolution <br />of the area's development problem. Again, the addition of <br />the land to the rear of 134 Twin Lake Boulevard; defines and <br />resolves the future of this otherwise land- locked area. Defined <br />frontage and access is also provided by this proposal for <br />the 140 Twin Lake Boulevard property. Other than general <br />lot configuration, topography, access and utilities have not <br />at this time been reviewed. These matters require attention <br />and will be addressed if and when the initial variance is <br />determined as acceptable and the subsequent required subdivision <br />is approved. At such time, frontage and right -of -ways will <br />also be considered, especially•in regard to the configuration <br />of 138 and 140 Twin Lake Boulevard. In this regard, we also <br />recommend that any subdivision offered for consideration be <br />in the form of a formal plat. <br />In reviewing this request, note should also be made that the <br />area falls within the shoreland overlay zoning district. <br />Due however to the size and location of the property, there <br />are no special concerns which are evident as a result of this <br />special contract. <br />Page 48 <br />Page 36 <br />
