MINUTES CITY COUNCIL JULY 26, 1995 AMEND ZONING CODE RELATIVE TO CONDITIONAL USE PERMITS CONSENT AGENDA Mr. LaValle introduced the following resolution and moved its adoption: RESOLUTION NO. 95 -7 -176 - CONTINUING THE PUBLIC HEARING TO CONSIDER THE VACATION OF A PORTION OF JACKSON STREET UNTIL THE AUGUST 23, 1995 REGULAR COUNCIL MEETING The foregoing resolution was duly seconded by Pedersen. Ayes (3) LaValle, Pedersen, Scalze. Nays (0). Abstentions (1) Morelan. Resolution declared adopted. Scalze opened the public hearing to consider amending Section 921.O10.C. of the Zoning Code relative to Conditional Use Permits. It was noted that the Planning Commission recommended approval of the amendment. The City Administrator reported that the amendment strengthened requirements for granting Conditional Use Permits. The amendment places the burden of proof on the applicant to show that approval of the CUP would not be a detriment to surrounding properties. There was no one present from the general public wishing to comment on this matter. Upon motion by Morelan, seconded by LaValle, the public hearing was closed. . Mr. Morelan introduced the following ordinance and moved its adoption: ORDINANCE NO. 417 - AMENDING SECTION 921.010.C. OF THE ZONING CODE RELATING TO CONDITIONAL USE PERMITS The foregoing ordinance was duly seconded by LaValle. Ayes (4) Morelan, LaValle, Scalze, Pedersen. Nays (0). Ordinance declared adopted. Mr. LaValle introduced the following resolution and moved its adoption: RESOLUTION NO. 95 -7 -177 - APPROVING THE CONSENT AGENDA WHICH CONTAINS THE FOLLOWING ITEMS: *ORDINANCE NO. 418 REPEALING CHAPTER 209, PERSONNEL ORDINANCE; *APPROVAL OF TEMPORARY LIQUOR LICENSE FOR CANADIAN DAYS COMMITTEE FOR CANADIAN DAYS CELEBRATION ON 3 Page 49
