MINUTES <br />CITY COUNCIL <br />JULY 26, 1995 <br />AMEND ZONING <br />CODE RELATIVE <br />TO CONDITIONAL <br />USE PERMITS <br />CONSENT <br />AGENDA <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 95 -7 -176 - CONTINUING THE PUBLIC HEARING <br />TO CONSIDER THE VACATION OF A PORTION OF JACKSON STREET <br />UNTIL THE AUGUST 23, 1995 REGULAR COUNCIL MEETING <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (3) LaValle, Pedersen, Scalze. <br />Nays (0). <br />Abstentions (1) Morelan. Resolution declared adopted. <br />Scalze opened the public hearing to consider amending <br />Section 921.O10.C. of the Zoning Code relative to <br />Conditional Use Permits. It was noted that the <br />Planning Commission recommended approval of the <br />amendment. <br />The City Administrator reported that the amendment <br />strengthened requirements for granting Conditional Use <br />Permits. The amendment places the burden of proof on <br />the applicant to show that approval of the CUP would <br />not be a detriment to surrounding properties. <br />There was no one present from the general public <br />wishing to comment on this matter. <br />Upon motion by Morelan, seconded by LaValle, the public <br />hearing was closed. <br />. Mr. Morelan introduced the following ordinance and <br />moved its adoption: <br />ORDINANCE NO. 417 - AMENDING SECTION 921.010.C. OF THE <br />ZONING CODE RELATING TO CONDITIONAL USE PERMITS <br />The foregoing ordinance was duly seconded by LaValle. <br />Ayes (4) Morelan, LaValle, Scalze, Pedersen. <br />Nays (0). Ordinance declared adopted. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 95 -7 -177 - APPROVING THE CONSENT AGENDA <br />WHICH CONTAINS THE FOLLOWING ITEMS: <br />*ORDINANCE NO. 418 REPEALING CHAPTER 209, PERSONNEL <br />ORDINANCE; <br />*APPROVAL OF TEMPORARY LIQUOR LICENSE FOR CANADIAN <br />DAYS COMMITTEE FOR CANADIAN DAYS CELEBRATION ON <br />3 <br />Page 49 <br />
