804. SOLICITORS. <br />804.010. TERM. A solicitor, for the purpose of this <br />Chapter, shall be defined to be any person who goes from house to <br />house, or from place to place, in the City, selling or taking <br />orders for, or offering to sell or take orders for, goods, wares or <br />merchandise or any articles for future delivery, or for services to <br />be performed in the future, or for making, manufacturing or <br />repairing of any article or thing whatsoever for future delivery; <br />provided, however, that this Chapter shall apply only to solicitors <br />who demand, accept, or receive payment or deposit of money in <br />advance of final delivery. <br />804.020. PERMIT. It shall be unlawful for any person to <br />act as solicitor within the meaning of this Chapter without first <br />securing a permit from the City Clerk in accordance with the <br />provisions hereto. <br />804.030. WRITTEN APPLICATION. That hereafter any <br />applicant for a permit to engage in the business of a solicitor, as <br />herein defined, shall file with the City Clerk a written <br />application for such permit, on a form to be provided, stating the <br />name and address of the applicant, the name and address of the <br />person, firm or corporation which he represents, the kind of goods <br />offered for sale, or kind of service performed. In the case of <br />certain solicitations covering the entire City, the Council may <br />waive licenses and require a surety bond in such amount as the <br />Council may determine. Such bond, when required, shall provide for <br />indemnification if any funds paid to solicitors are fraudulently or <br />unlawfully diverted by solicitors or those responsible for the <br />solicitation. <br />804.040. PERMIT FEE. Upon payment of Ten Dollars <br />($10.00) to the City Treasurer, the Clerk shall issue a solicitor's <br />non - transferable permit for the period of one (1) year, permitting <br />said person to operate as a solicitor, as herein provided. Any <br />person, upon the expiration of the term of his permit, may renew <br />same by paying an annual fee of Ten Dollars ($10.00), said <br />application for renewal to be made to the Clerk. <br />(Source: Ord. 38, Amended: Ord. 198) <br />Page 9 <br />
