4.4 • . : :1141/4 MO 1 THIS AGREEMENT, made this day of by and between David Allen Smith, Grantor, a single person, and the City of Little Canada, a municipal corporation under the laws of the State of Minnesota, Grantee; WITNESSETH, that the. said Grantor, in consideration of One and No /100 ($1.00) Dollars to them in hand paid by said Grantee, and for other good and valuable consideration, the receipt of which is hereby acknowledged, hereby grant and warrant to said Grantee, its successors and assigns, a permanent easement for street, drainage, and utility purposes, and for ingress and egress at any and all times with all machinery, equipment and materials necessary for the aforesaid purpose, in, over, and upon the following described property owned by Grantor and situated in Ramsey County, Minnesota, which permanent easement is described as follows: Permanent Easements for Street, Drainage, and Utility Purposes: The East 12.50 feet of that part of the North 70 rods of the South 120 rods of the East 50 rods of the Southeast quarter of Section 8, Township 29, Range 22, which lies North of Minnesota Trunk Highway No. 36, except the East 607 feet thereof and except the West 12.5 feet of the East 619.5 feet of the North 252.5 feet thereof, subject to easement for roadway in East 12.5 feet of that part of tract herein described lying South of the North 252.5 feet thereof, according to U.S. Government Survey, lying Westerly and Southwesterly of a line 20.00 feet Westerly, Southwesterly of and parallel with the following described line: Commencing at a point on the east line of said Section 8, distant 1970.07 feet north of the southeast corner thereof; thence westerly at an angle of 89 degrees 27 minutes 30 seconds with said east section line, Page 21
