... k • • ; 4.4J. \ 4 THIS AGREEMENT, made this J1 day of , 1995, by and between Michael T. Gawreluk and Susanne M. Gawreluk, husband and wife, Grantors, and the City of Little Canada, a municipal corporation under the laws of the State of Minnesota, Grantee; WITNESSETH, that the said Grantors, in consideration of One and No /100 ($1.00) Dollars to them in hand paid by said Grantee, and for other good and valuable consideration, the receipt of which is hereby acknowledged, hereby grant and warrant to said Grantee, its successors and assigns, a permanent easement for street, drainage, and utility purposes, and for ingress and egress at any and all times with all machinery, equipment and materials necessary for the aforesaid purpose, in, over, and upon the following described property owned by Grantors and situated in Ramsey County, Minnesota, which permanent easement is described as follows: Permanent Easements for Street, Drainage, and Utility Purposes: The West 12.50 feet of that part of the East 299.00 feet of the South 120 rods of the Southeast Quarter of Section 8, Township 29, Range 22, which lies North of and West of right -of -way of the Minnesota Trunk Highway No. 36, except the North 268 feet thereof. TO HAVE AND HOLD said Easement unto said Grantee and its assigns. The Grantors hereby warrant the title to the Easement property and will defend such title against the lawful claims of all persons.
