MINUTES <br />CITY COUNCIL <br />JUNE 28, 1995 <br />house into an existing neighborhood in the conditional <br />use section of the Zoning Ordinance was more <br />appropriate than adopting an infill ordinance. Scalze <br />pointed out that this would direct the process to the <br />Planning Commission and City Council rather than staff. <br />There was no one from the general public present <br />wishing to comment on this matter. <br />Upon motion by LaValle, seconded by Pedersen, the <br />public hearing was closed. <br />Morelan suggested that the Council deny the proposed <br />infill ordinance and call a public hearing to consider <br />amending the conditional use permit section of the <br />Zoning Ordinance. <br />Scalze agreed, but questioned putting the burden of <br />proof on the applicant. <br />Fahey felt that the applicant should be required to <br />establish clear and convincing evidence that the <br />standards of the ordinance have been met. Fahey <br />pointed out that this proof could also come from other <br />sources, such as the City Planner's findings, <br />recommendations of staff, etc. <br />Mr. Morelan introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 95 -6 -156 - DENYING THE PROPOSED <br />AMENDMENT TO SECTION 903.020 OF THE ZONING ORDINANCE <br />ESTABLISHING AN ADMINISTRATIVE DESIGN REVIEW PROCEDURE <br />AND DESIGN STANDARDS FOR INFILL RESIDENTIAL DEVELOPMENT <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Morelan, Scalze, Pedersen, Fahey, LaValle. <br />Nays (0). Resolution declared adopted. <br />Mr. Morelan introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 95 -6 -157 - CALLING A PUBLIC HEARING FOR <br />JULY 26, 1995 AT 7:30 P.M. TO CONSIDER AMENDING SECTION <br />921 OF THE ZONING CODE RELATIVE TO PROCESSING OF <br />CONDITIONAL USE PERMIT APPLICATIONS AS RECOMMENDED BY <br />CITY STAFF AND INCLUDING THE REQUIREMENT OF SUBMISSION <br />BY THE APPLICANT OF CLEAR AND CONVINCING EVIDENCE THAT <br />THE STANDARDS OF THE ORDINANCE ARE BEING MET <br />3 <br />Page 24 <br />
