Hanson <br />Attached are two pieces of correspondence regarding concerns over <br />water craft operation at the south end of Lake Gervais. The <br />first is from Mr. Gordon Forbes who has expressed concerns with <br />safety and time of operation regarding high powered boats and jet <br />skis in the vicinity of his home and the swimming beach. The <br />second letter is from Lieutenant Jerry Bergeron which addresses <br />safety concerns raised by operation of water craft in the <br />vicinity of the public beach. <br />To address this issue, Lieutenant Bergeron has recommended that a <br />no wake zone be placed across the bay located at the southwest <br />corner of Lake Gervais. (See map attached.) He felt this would <br />create a much safer environment for the people using the beach <br />and would also address the concerns raised by Mr. Forbes. He <br />indicated that the cost of placing ten buoys across this area <br />could be shared equally between the City of Little Canada and <br />Ramsey County Parks & Recreation. The cost to Little Canada <br />would be approximately $375. <br />The principle concern I have in this matter is our ability to <br />regulate this bay given that this body of water has shared <br />jurisdiction with the City of Maplewood. Lieutenant Bergeron has <br />felt that because the bay is located entirely within our City, we <br />would be able to regulate that area. Mr. Kim Elbrem of the <br />Minnesota Department of Natural Resources has also indicated we <br />can do this given the nature of this issue. Furthermore, to <br />enact an ordinance requires a public hearing and subsequent <br />approval by the DNR. Therefore, this process does not happen <br />quickly. <br />The City Attorney should be able to comment on the ordinance <br />adoption process at Wednesday's meeting.
