MINUTES <br />City Council <br />March 4, 1987 <br />Fahey noted that Deeb and Donovan were opposed to the road due <br />to the cost and that the City could not grant a variance that was <br />based on economic hardship, but only if a property was deprived <br />of a right that everyone else is enjoying. <br />Deeb noted that the City grants industrial revenue bonds to other <br />developments in the City. <br />Fahey pointed out that this practice does not cost the City any <br />money, and the developer obtains his own financing. <br />Deeb noted that he will be paying sanitary sewer assessments in <br />the future when the Gervais property develops, and the cost <br />of these assessments hasn't been determined. <br />Fahey noted that Deeb had a business decision to make whether he <br />wanted to continue as he currently is, or if he should add on the <br />2,000 square feet that he has proposed with the requirement of <br />road access, or find another piece of property which already has <br />road access. Fahey pointed out that the City cannot grant a <br />building permit for Deeb or Donovan and increase the existing <br />non - conformity. <br />Donovan pointed out that he needs an addition to his building, <br />and felt the City was forcing him out of business by requiring <br />the road in order that he can get a building permit to add on. <br />Scalze pointed out that these are some of the few properties in the <br />City that do not have sewer, water or street. <br />LaValle pointed out that if the amount of the assessment does not <br />increase the value of the property in a similar amount, the property <br />owners could appeal the assessment. <br />Fahey suggested that as part of the issuance of a building permit, <br />the City could require an agreement that the property owners will <br />not appeal the assessment. <br />Deeb pointed out that there is only one side of the street to <br />assess, and he and Donovan would have to pay'the full assessment. <br />Donovan asked if it would be possible to obtain a remodeling permit. <br />Fahey replied that the Building Inspect and City Planner would have <br />to reply to that question. <br />Donovan asked why a road should be improved that will serve no one. <br />Donovan reported that he and Deeb have adequate access presently. <br />LaValle asked if the McGough property was interested in the road. <br />Page 8 <br />
